Terms of Use

1. Introduction

Welcome to Canvastera, a SaaS product provided by RedTag s.r.o. (more as Canvastera), a legal entity located in the Czech Republic, with the address Štepánská 704/61, 110 00 Prague, ID: 06896626, VAT: CZ06896626. These Terms of Use govern your use of Canvastera.

By accessing or using Canvastera, you agree to comply with and be bound by these terms and terms of other embeded content providers such as: YouTube, Vimeo, Google, Flickr, Sketchfab and others (you can see all embedded content in the links button in the poster view).

When we say ”company”, “we”, “our”, “us”, ”service” or ”services” in this document, we are referring to Canvastera.

2. Beta Disclaimer

Canvastera is currently in beta, and as such, features and functionalities may change without prior notice. Users acknowledge that they are using the beta version at their own risk. Canvastera reserves the right to modify or discontinue the service at any time during the beta period.

3. User Data Responsibility

Users are solely responsible for the data they upload to Canvastera. By uploading data, users confirm that they own the rights to the data and accept full responsibility for it. Canvastera assumes no liability for user-uploaded content.

4. Data Linking

Canvastera allows users to link data from other sites. Users must ensure they have the appropriate rights to link and use data from external sources. Canvastera is not responsible for the content linked from other sites.

5. Ownership of Uploaded Data

The user owns all uploaded data. Canvastera retains the right to display the data and delete it when necessary.

6. Prohibited Content

Users are strictly prohibited from uploading, sharing, or creating any harmful, offensive, or illegal content, including but not limited to harmful images or text. Canvastera reserves the right to remove any content that violates this provision and take appropriate action against the user.

7. GDPR Compliance

Canvastera complies with the General Data Protection Regulation (GDPR). Canvastera is committed to protecting user privacy and ensuring the security of user data. For more information about how we handle user data, please refer to our Privacy Policy.

8. Termination of Beta Access

Canvastera reserves the right to terminate a user's access to Canvastera at any time, for any reason, without notice. Upon termination, users must cease using the service and delete any downloaded or saved data from Canvastera.

9. Cancellation and Termination

Cancellation by You:

You can cancel your Canvastera account at any time by contacting our support team at support@canvastera.com.

  • If you cancel before the end of your current billing period, your cancellation will take effect at the end of that period. You will not be charged again.

Termination by Canvastera:

We reserve the right to suspend or terminate your account and refuse service for any reason at any time. This may include account deactivation, deletion of your data, and barring future use of the service.

  • Reasons for termination may include, but are not limited to, violation of our terms of service or abusive behavior towards our customers, employees, or officers.

10. Changes to Terms

Canvastera may update these Terms of Use from time to time, and users are encouraged to review them periodically. Continued use of Canvastera after any changes constitutes acceptance of the updated terms.

12. Free Account Model

This applies after beta is closed. Expected date 1. 9. 2024.

The Free Account Model allows all access to our editor and functionalities (except add-ons). However, there are some limitations:

  • Posters will be locked for edit and view after 7 days from the creation date.
  • Locked content will be permanently deleted after 60 days unless an account is upgraded to a paid plan. We cannot recover permanently deleted content.

13. Payments, refunds, upgrading and downgrading terms

Payment:

  • We do not store your credit card information and do not sell your data.
  • Prepaid Plan: Paid plans require prepayment to maintain service of billing period you choose (monthly / yearly).
  • If payment is not received, your account will transition to the Free Account Model, with limitations on features and data availability (see Section 12: Free Account Model for details).

Billing:

  • Paying customers are automatically billed via credit card or PayPal (depending on your preference during checkout with Paddle.com).

Account Management:

  • You can upgrade or downgrade your plan (to paid or Free Account Model) at any time within your account settings or by contacting support at support@canvastera.com.
  • Downgrading may cause feature loss and potential data loss for exceeding users (who will transition to the Free Account Model). We are not liable for such data loss.

Payment Processing:

  • Paddle.com handles all payment processing, customer service inquiries, and returns.
  • Fees are inclusive of all taxes. Paddle collects and remits taxes to the relevant authorities. See Paddle's Terms of Use for details.
  • Fees are non-refundable.

Refunds

  • We offer 48-hours refund period for your Paid Plan if your account / group users has no posters created.
  • Canvastera has no liability to you, nor any obligation to provide a refund to you, in connection with internet or other Canvastera Service outages or failures that are caused by the actions of government authorities, other third parties, or events beyond our control.

14. Modifications to the service and prices

We reserve the right to modify or discontinue any part of the service, temporarily or permanently, with or without notice.

  • We strive to exempt existing customers from price changes. However, we may occasionally adjust pricing and will provide at least 30 days' notice via email, blog post, or changelog update.
  • Canvastera is not liable for any service modifications, price changes, suspensions, or discontinuations.
  • If you have prepaid fees directly to Canvastera for a Paid Plan that Canvastera permanently discontinues prior to the end of your Prepaid Period (as that term is defined in the "Payments" section above), Canvastera will refund you the prorated portion of the prepaid fees for the Prepaid Period after such discontinuation. Your account and billing information must be up to date in order for us to refund you.
